GovernanceWest Eugene Village Homeowners Association, Inc. existence and operation is determined by a set of governing documents. The documents are listed in order of precedence from highest to lowest. The CC&R’s outweigh Bylaws that outweigh Articles of Incorporation that outweigh Rules. Applicable Oregon statutes and Federal laws supersede all documents. ORS Chapter 94 – Real Property Development (aka The Planned Community Act) governs many functions and procedures. ORS Chapter 65 – Nonprofit Corporations governs many Board of Director procedures.

The CC&R’s state important HOA governing topics including the Board’s rights and responsibilities to govern and enforce Association rules, property standards, and terms. CC&R’s also include owner rights and responsibilities, use and maintenance of common area versus private residence, and discuss procedures for making amendments. BYLAWS
Bylaws set the Board’s responsibilities for conducting meetings, elections, reviewing policies, review and set annual budget and exercising their powers and duties to enforce rules. Bylaws also set HOA procedures for things like fix the amount of the annual assessments, force foreclosure lien against property for which assessments are not paid within 90-days, make special appointments to the Board and appoint committees.
